WHAT TYPE OF INFORMATION WE COLLECT

We need to maintain regular communication with our studio owners. To enable us to interact with our studio owners and anyone interested in becoming a studio owner, we may collect the following information:

Basic Identifying Information. Your first name, last name, postal address, e-mail address, and phone number.
Payment Information. Information such as a bank account number, billing address, and other related payment information provided to facilitate the transfer of funds under the terms of a franchise agreement.
Commercial Information. Information to enable us to determine your ability to dedicate sufficient time and financially commit to running a studio.

HOW DO WE COLLECT YOUR INFORMATION

We collect your information in three ways: (1) directly from you when you communicate with us; (2) automatically using online technologies when you engage with our franchisee platforms; and (2) when you provide us with authorization, from our third party partners.

Directly from you. We collect information directly from you when you enter your information on our website, create an account in our franchisee platforms, engage in Communications with us, or sign-up to receive emails, text messages, or certain other Communications from us.
Automatically Using Online Technologies. When you use our franchisee platforms, we or other third parties may automatically collect certain information about you using online tracking technologies such as cookies, pixels, web beacons, software developer kits, and related technologies as further set out in our franchise agreement to provide you with our services and ensure the security of our platforms.
From Third Parties. When you provide us authorization to do so, we collect information from third parties as follows:
- Third-party Service Providers. B3 Studios receives information about you from third-party service providers who act on our behalf. These services include providing analytics, security services, sending marketing communications, and providing cloud infrastructure.
- Partners. We receive information about you from our partners who provide a variety of services to B3 Studios. These services may include consulting, training, analytics, marketing, and advertising.

Directly from you. We collect information directly from you when you enter your information on our website, create an account in our franchisee platforms, engage in Communications with us, or sign-up to receive emails, text messages, or certain other Communications from us.
Automatically Using Online Technologies. When you use our franchisee platforms, we or other third parties may automatically collect certain information about you using online tracking technologies such as cookies, pixels, web beacons, software developer kits, and related technologies as further set out in our franchise agreement to provide you with our services and ensure the security of our platforms.

HOW WE USE YOUR INFORMATION

Facilitate our Franchise Relationship. We use your information to provide you with information about opportunities to own and operate a studio and to manage our relationship with our franchise partners, including to: (1) create and manage your account to obtain access to franchisee platforms; (2) authenticate your account; and (3) diagnose technical problems and provide technical support.
Communicate with You. We use your information to engage in Communications with you, such as to respond to your requests, inquiries, issues, feedback, and to provide customer service.
Security and Fraud Prevention. We use your information to detect, investigate, prevent, or take action regarding possible malicious, deceptive, fraudulent, or illegal activity, including fraudulent transactions.
Legal Obligations. We use your information to comply with our legal and regulatory obligations, to establish and exercise our rights, and to defend against legal claims.
Business Functions. We use your information to support our core business functions, including to maintain records related to business management, loss prevention, and enforce the terms of our franchise agreement.

We may disclose or share your information with affiliated and non-affiliated third-parties, including in the following scenarios:

Other Barre3 Studio Owners. We may make your profile available to other studio owners to facilitate communications between studios.
Third-party Service Providers. B3 Studios uses third-party service providers who act on our behalf. These third parties are authorized to use information about you to provide these services to us, such as auditing, debugging to identify and repair errors that impair existing intended functionality on our franchisee platforms, and/or protecting against malicious, deceptive, fraudulent, or illegal activity.
Business Transfer Events. If B3 Studios becomes involved in a merger, acquisition, joint venture, corporate reorganization, financing, any form of sale of some or all of its assets, or in the unlikely event of insolvency, bankruptcy, or receivership, we may transfer information about you in connection with such event.
Public authorities. In certain situations, we may be required to disclose information about you in response to lawful requests by public authorities, including national security and local law enforcement. We may also disclose information about you if we have a good faith belief that access, use, preservation or disclosure of such information is reasonably necessary to:
- Comply with applicable law, regulation, subpoena, legal process, or enforceable governmental request
- Enforce our franchise agreement, including investigation of potential violations thereof
- Detect, prevent, or otherwise address fraud, security or technical issues
- Protect against imminent harm to the rights, property or safety of B3 Studios, its users or the public as required or permitted by law

If you provide us with your mobile telephone number, we will not share this information with third parties or affiliates for marketing or promotional purposes.

You may access, update, or remove certain information that you have provided to us through your account by visiting your account settings or sending an email to the email address set out as set out in the Contact Us section below. We may require additional information from you to allow us to confirm your identity.

Please note that we will retain and use information about you as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Communications

The following is information about how to opt out of receiving certain communications from, depending on means of delivery:

Transactional communication. From time to time, we may send you transactional email with announcements, payment confirmations, changes to our services, and other similar administrative messages. You do not have the opportunity to opt out of receiving these messages.
Text Messages. If you have opted-in to receive SMS messages from us, you can opt-out by replying STOP.
Push Notifications. If you have opted-in to receive push notification on your device, you can opt-out at any time by adjusting the permissions in your device or uninstalling our mobile application.

HOW WE PROTECT YOUR INFORMATION

We use reasonable and appropriate physical, technical, and administrative industry safeguards to protect information from unauthorized access, use, disclosure, destruction, loss, misuse or unauthorized alteration. We will make reasonable efforts to protect personal information stored on our servers from unauthorized access using commercially available computer security products (for example, firewalls), as well as carefully developed security procedures and practices.

INTERNATIONAL TRANSFERS

B3 Studios, its Services, and users are based in the United States (the “US”), Canada, and the Philippines. When you are a studio owner or contact us with interest in becoming a studio owner, we may transfer, store, and process information about you to servers and databases located outside of your home country. The privacy and data protection laws in the US may not be equivalent to such laws in your country of residence.

DATA STORAGE AND RETENTION

We store your information as long as necessary to provide our Services and to fulfill our business, legal, and contractual obligations. If you contacted us to inquire about franchise options and do not become a studio owner, B3 Studios will delete your contact information and any other information provided after 50 months. We will retain data pertaining to studio owners as set out in our franchise agreement.

UPDATES TO OUR PRIVACY NOTICE

We periodically review and update this Notice to reflect current technologies, new business practices, or changes in legal circumstances. When we do, we will revise the "Effective Date" at the top of this Privacy Notice. We encourage you to review this Notice periodically for any updates. If we are going to use information in a manner that is materially different from that stated at the time of collection or make any material changes in our privacy practices, and, if the changes are significant, we will provide a more prominent notice (including, for certain services, email notification of policy changes). Continued access or use of the Site shall constitute your express acceptance of any modifications to this Notice. If you do not agree with the privacy practices disclosed in the Privacy Notice, we recommend that you stop using our Services.
